General Terms and Conditions
for the eHive international online store (smartbeekeeping.eu)

These General Terms and Conditions (hereinafter the “GTC”) govern the rights and obligations between the seller and the buyer when purchasing goods through the eHive international online store.
The seller’s identification and contact details, the supervisory authority, and information on alternative dispute resolution are provided in the separate document “Identification Details and Mandatory Information of the eHive International Online Store” (Annex No. 1).
1. Definitions
“Buyer” means a person who has sent an order through the e-shop.
“Consumer” means a natural person who, when concluding and performing the contract, does not act within the scope of their business activity or profession.
“Business customer” means a person acting within the scope of their business activity or profession; a purchase made under a Company ID is also considered a business purchase.
“Goods” means in particular the hive scale, GSM module, and accessories offered in the e-shop.
“Application” means the eHive mobile or desktop application intended for controlling devices and displaying data from them.
“Service” means in particular the transfer and storage of data from devices (e.g. in GSM mode) and making such data available in the Application, if provided.
2. Order and conclusion of the purchase contract
2.1 By sending the order, the buyer submits a proposal for concluding a purchase contract.
2.2 The purchase contract is concluded upon delivery of the order confirmation from the seller to the buyer by email.
2.3 The seller is entitled not to confirm the order, especially if the goods are unavailable, if there has been an obvious pricing error, or if there is a reasonable suspicion of abuse of the ordering system.
2.4 The buyer may cancel the order up until dispatch by email or by phone. After dispatch, the procedure under Article 6 (withdrawal from the contract) applies for consumers.
3. Price of goods and currencies
3.1 Prices are shown in the currency available for the selected destination country. The available currencies and destination countries are shown in the e-shop before the order is submitted.
3.2 Prices are final. The seller is not VAT registered, therefore invoices are issued without VAT.
4. Payment terms
4.1 The buyer may use the payment methods shown in the e-shop for the selected destination country and order, in particular bank transfer and, where offered, cash on delivery.
4.2 In the case of advance payment, the seller dispatches the goods after the full purchase price has been credited to the seller’s account.
4.3 For higher-value orders, the seller may require advance payment (a deposit), especially for custom-made orders under Article 11.
5. Delivery of goods and shipping
5.1 Available delivery methods depend on the selected destination country and are shown in the e-shop before the order is submitted. If personal collection is offered, it is only by prior arrangement.

5.3 The goods are delivered at the moment they are received by the buyer or by a person designated by the buyer.
5.4 The risk of damage to the goods passes to the buyer upon receipt of the goods.
5.5 Unless the parties agree otherwise, the seller will deliver the goods no later than 30 days after conclusion of the contract.
6. Withdrawal from the contract (consumer)
6.1 The consumer has the right to withdraw from the contract without stating any reason within 14 days from the day of receipt of the goods.
6.2 The withdrawal must be made by an unambiguous statement (e.g. by email or post). A form may be available on the website, but its use is not mandatory.
6.3 The consumer is obliged to send or hand back the goods no later than 14 days from the day of withdrawal from the contract. The consumer bears the direct costs of returning the goods.
6.4 The consumer is liable for any reduction in the value of the goods resulting from handling beyond what is necessary to establish the characteristics and functionality of the goods.
6.5 The seller will refund to the consumer all payments received, including delivery costs corresponding to the cheapest standard delivery method offered by the seller, no later than 14 days from the day the withdrawal is delivered. Additional costs resulting from the consumer’s choice of a more expensive delivery method will not be refunded, unless legal regulations provide otherwise. The seller may withhold the refund until the goods have been returned or until proof of their dispatch has been provided.
6.6 Goods sent cash on delivery may not be accepted; it is recommended to send the goods using a standard shipping method.
7. Exceptions from the right of withdrawal
The consumer’s right to withdraw from the contract does not apply in particular to:
goods made according to the consumer’s specification or custom-made goods (Article 11),
the provision of a service or the supply of digital content if performance began with the consumer’s consent and the consumer was informed of the loss of the right of withdrawal (e.g. an activated SIM subscription, if provided as a service).
8. Liability for defects and complaints
8.1 The consumer may exercise rights arising from liability for defects within the statutory period. The seller is liable for defects that appear within 24 months from receipt of the goods, unless legal regulations provide otherwise.
8.2 For a business customer, the seller provides liability for defects for 12 months from receipt of the goods, unless the parties agree otherwise. Legal relations with business customers are governed by the Commercial Code.
8.3 Complaints and service are handled at the service address: Sedliacka Dubová 93, 027 55 Sedliacka Dubová, Slovakia.
8.4 The complaint should include a description of the defect, identification of the device, and proof of purchase (electronic form is sufficient). Failure to use the complaint form does not in itself prevent the complaint from being made.
8.5 The seller will handle the complaint without undue delay, no later than 30 days from the date it is made, unless legal regulations provide otherwise.
8.6 The method of handling the complaint depends on the nature of the defect and may include repair, replacement, an appropriate discount, or refund of the purchase price, in accordance with legal regulations.
8.7 We recommend sending goods for complaint handling without cash on delivery. In the case of a justified complaint, the consumer has the right to reimbursement of reasonably incurred costs related to making the complaint, to the extent provided by legal regulations.
9. Goods with digital elements, the Application, and updates
9.1 The devices contain embedded firmware and may use the eHive Application. In some modes (e.g. GSM), the Application and online service are necessary for full use of the functions.
9.2 The seller provides the consumer with updates (including security updates) that are necessary to maintain conformity of the goods with digital elements and that the consumer may reasonably expect with regard to the nature and purpose of the goods.
9.3 Updates may be delivered, for example, through the eHive Application or by another appropriate method. The buyer is obliged to install the updates within a reasonable time; otherwise, this may result in a limitation of liability for defects caused solely by failure to install the update.
9.4 Compatibility of the Application may depend on the user’s operating system version and hardware. The seller does not guarantee support for all older OS versions and may discontinue support for older versions after a reasonable period.
9.5 The online service (data transfer/storage) is provided on a “best effort” basis, without a guarantee of uninterrupted availability. The seller may perform maintenance or system changes; to a reasonable extent, the seller will seek to limit the impact on users.
9.6 The licensing conditions for the use of the eHive Application are governed by the separate document “License Terms of the eHive Application”.
10. SIM card and subscription (if relevant)
10.1 Functionality of the GSM module depends on the availability of the mobile network and on the use of a SIM card. As a rule, the buyer obtains the SIM card themselves; in selected variants, the SIM card may be supplied by the seller.
10.2 If the SIM card is supplied by the seller, it may be tied to a specific mobile operator according to the current offer. The seller reserves the right to change the operator in future deliveries.
10.3 If the delivery includes a time-limited subscription, further operation after expiry of the prepaid period may be conditional upon its renewal. Outages of the mobile network or operator service are beyond the seller’s control.
11. Custom manufacturing and individual solutions
11.1 Custom-made goods mean goods modified or manufactured according to the buyer’s individual specification and not normally offered in the e-shop.
11.2 For custom-made goods, the seller may require a deposit and agree on individual delivery terms.
11.3 As a rule, the consumer’s right to withdraw from the contract without stating a reason does not apply to custom-made goods if the statutory conditions for the exception are met (Article 7).
12. Nature of the device and limitation of use
12.1 The devices are intended for indicative monitoring of weight changes and related data. The data are informative and auxiliary in nature.
12.2 The devices are not intended for official, commercial, or billing measurements and are not intended for use within the meaning of metrology legislation. They are not designated measuring instruments or calibrated metrological devices.
12.3 Measurement accuracy may be affected in particular by installation, uneven loading, weather conditions, power supply status, mechanical wear, and signal quality.
12.4 The devices are not a certified security or alarm system. Notifications or alarm functions are only supplementary and informational in nature. The seller is not liable for damage arising as a result of theft, vandalism, intervention by a third party, or communication outage, unless legal regulations provide otherwise.
12.5 The devices are not intended for use in an environment with explosion risk or in other specific industrial applications.
13. Limitation of liability and support
13.1 The seller is a small manufacturer and service operator. Customer support is provided to a reasonable extent and without guaranteed response times; this does not affect the consumer’s statutory rights.
13.2 The seller is not liable for damage caused by incorrect installation, unprofessional intervention, improper power supply, use of an unsuitable SIM card, or outages of the mobile network. This does not affect the consumer’s statutory rights arising from liability for defects or any liability that cannot be excluded or limited under legal regulations.
13.3 Relationship with a business customer: to the extent permitted by legal regulations, the seller’s liability for indirect damage and lost profit is excluded and the seller’s total liability is limited to the price of the delivered goods, except for damage caused intentionally or by gross negligence, unless legal regulations provide otherwise.
14. Final provisions
14.1 These GTC are valid and effective from the date of their publication on the e-shop website.
14.2 Legal relations are governed by the legal order of the Slovak Republic. If the buyer is a consumer habitually resident in another EU Member State, this does not affect mandatory provisions of law that provide them with a higher level of protection.
14.3 The seller reserves the right to amend the GTC to a reasonable extent; for a specific order, the wording effective at the time the order is sent shall apply.
